根据家庭法，法庭必须作出或批准法庭令让孩子们和家长一方共同生活，并和另一方有时间相处，或者让孩子跟两位家长有同等相处时间。那家庭宠物又该如何安排呢？
案例分析
在2007年的Jarvis & Weston案中，关于孩子抚养权的法庭诉讼持续已经快六年。在终审聆讯的第11个小时出现了一个问题：宠物狗的归属。孩子曾经向家庭报告撰写者提及对狗的顾虑。在家庭报告中有一段说道：法庭可以研究证据来决定这一问题，从而双方得以最终解决抚养问题。
尽管根据提交法庭的文书，法庭没有司法权来作出关于宠物狗的任何命令， 法官就这一问题作出裁决：不管是应有的、相关的、固有的法庭司法权，还是国家亲权，只要有需求就能找到司法管辖权。孩子和狗紧密相依，孩子去哪狗就去哪。
所以在此案中，孩子和狗的亲近关系让法庭决定在孩子的抚养令里包含狗的归属安排。
宠物和家庭法
宠物不属于家庭法中对于“孩子“的定义，因此不能单独成为法庭抚养令中的对象。分居之后，您无法根据家庭法提出申请来要求跟宠物的相处时间。
前述的案例分析可以说是特例，而非惯例。一般来说，澳大利亚联邦巡回和家庭法法庭能作出的关于宠物的法庭令只能是财产分割的一部分，即宠物作为一项财产，归哪方所有。
