1987年工伤赔偿法案 （“1987 年法案”）第33条规定，如果雇员因为工作受伤并导致丧失部分或全部的工作能力，雇主则需向该雇员每周支付相应的赔偿金。而1987年法案的第43条则允许保险公司在特定情况下调赔偿金额，即保险公司可以基于受伤雇员具备在合适的工作岗位中工作的能力来下调每周支付给雇员的赔偿金。
如何定义“具备工作能力”？
根据 1987 年法案附表 3 第 9(1) 条规定，如果雇员能够回到受伤前的工作岗位继续工作，或者能够找到其它合适的工作岗位，那么保险公司就可以认为该雇员具备工作能力。
在 Lawarra Nominees P/L v Wilson [1996] NSWSC 584 一案中，Mahoney P 认为一个雇员是否具备工作能力取决于雇员的实际体力和当前的就业市场。出现纠纷时，法院会从实际的角度出发解决两个问题。第一，与雇员相关的劳动力市场有哪些；第二，依据雇员的健康状况，该雇员能从事什么样的工作。
如何定义“合适的工作岗位”？
1987年法案的第32A条指出，在考虑目前适合雇员的工作岗位时，保险公司需要对以下三方面进行衡量：
工伤性质以及医疗报告；
雇员的年龄、教育程度、技能水平以及工作经验；
返工计划；和
康复计划。
在 Wollongong Nursing Home Pty Ltd v Dewar [2014] NSWWCCPD 55 案中，雇员是一位兼职护理助理，在受雇期间受了伤。保险公司认定受伤雇员仍然具备在适合的岗位中工作的能力。 Roach P认为雇员不该因为失去了自己目前的工作为由否定了工作市场上仍然有适合她的的其他工作岗位。而确定雇员是否具备工作能力应该取决于上述的三个方面。
